Guaranteed Issue Rights

Guaranteed issue rights are situations where an insurer must sell you a Medigap policy without medical underwriting — it cannot deny you or charge more for health reasons. These rights apply during your Medigap open enrollment window and certain special circumstances.

Understanding Guaranteed Issue Rights

Guaranteed issue rights (also called Medigap protections) are situations in which an insurance company must sell you a Medigap policy, cannot turn you down for health reasons, and cannot charge you more because of pre-existing conditions. These rights protect you during specific windows and circumstances defined by federal and state law.

For beneficiaries, guaranteed issue is the difference between easily getting supplemental coverage and being denied. Common triggers include losing employer or union coverage, your Medicare Advantage plan leaving your area, or moving out of a plan's service area. Outside these windows, insurers in most states can use medical underwriting to deny or surcharge you.

For example, if your Medicare Advantage plan exits the market at year-end, you typically get a guaranteed-issue window to buy certain Medigap plans — the insurer must accept you at the best health rate regardless of any conditions you have.
